Irvin is a senior partner and Chair in the firm's Litigation Group and is an experienced mediator and arbitrator. He also served in management on the firm's Executive Committee for over 10 years. Additionally, Irvin is Chair of the Class Action Group and VehicuLAW – the Minden Gross motor vehicle dealers group.
Irvin has represented clients in a vast number of areas, including: shareholders' rights and remedies, applications for injunctive relief and judicial review, wrongful dismissal, defamation, corporate and commercial disputes, international litigation, including jurisdictional disputes, negligence and tort claims, sexual abuse litigation, real property litigation including commercial development disputes and commercial leasing disputes, pension and employment benefits disputes, prosecution and defence of solicitors' negligence and professional malpractice claims, and environmental litigation.
Irvin has acted on a number of high profile cases of national importance. He has conducted numerous cases against financial institutions. Irvin is particularly well known as having obtained an outstanding result for an entrepreneur client in an action against a financial institution that acted improperly in connection with a loan to the client. Notwithstanding that the actual loan amounted to approximately $200,000, the financial institution was ultimately ordered to pay almost $7 million in damages as a result of Irvin's efforts. Irvin was then successful in defeating the financial institution's appeal to the Court of Appeal. This case is widely regarded as one of the most significant lender liability cases of the 1990s.
Irvin has also achieved success on behalf of financial institutions, including a judgment of the Court of Appeal allowing his lender client to recover its funds where its mortgage was discharged in error, notwithstanding that the provisions of the Registry Act appeared to dictate the opposite result.
Irvin has substantial experience with litigation for international clients. He routinely handles numerous matters for companies based in the United States and the United Kingdom.
Irvin serves as a co-chair of the litigation section of Meritas. Currently, he serves as a member of the Board of Directors. Irvin is also a frequent author and lecturer on litigation practice-related matters. He regularly publishes on his blog, irvinschein.com.
Irvin earned his LLM in Alternative Dispute Resolution from Osgoode Hall Law School in 2014. He has substantial experience in arbitration and mediation proceedings and is listed as an arbitrator by the Canadian Commercial Arbitration Centre based in Montreal, QC. Irvin has developed a wide breadth of knowledge in a number of industries. Clients appreciate his willingness to take on their problems and relieve them of some of the burden. A born litigator, his advocacy and courtroom skills are highly developed after over 40 years of practice.
Irvin lives and breathes litigation, but his other passions are hockey and wine. Irvin is on the ice three times a week and has had specialized goalie training from Hall of Fame Russian goalie Vladislav Tretiak.
